the Admiralty under conditions which, during the

continuances of the charter, constitute the ship one

of His Majesty's ships.

The several persons whose names are hereunto subscribed, being British subjects, and whose descriptions are set forth against their signatures, hereby agree with Robert Fleming Herschel for and on behalf of the Lords Commissioners of the Admiralty to serve on board the said ship in the several capacities expressed against their respective names for any period not exceeding six months, but the Agreement to be terminable at a port in the United Kingdom after three months on either party giving seven days' notice.

(1.) The several persons whose names are hereunto subscribed agree that they shall be subject to the

Naval discipline Act:

 

(2.) Any offence committed by any such person shall be tried and punished as the like offence might be

tried and punished if committed by any person in or belonging to His Majesty's Navy, and borne

on the books of any of His Majesty's ships in commission:

 

(3.) Every such offender who is to be tried by Court-martial shall be placed under all necessary restraint

until he can be tried by Court-martial:

 

(4.) On application made to the Lords of the Admiralty, or to the Commander-in-Chief, or senior

officer of any of His Majesty's ships or vessels of war abroad authorised to assemble and hold

Courts-martial, the Lords of the Admiralty, Commander-in-Chief, or senior officer (as the case

may be) shall assemble and hold a Court-martial for the trial of the offender:

 

(5.) The officer commanding shall have the same power in respect of all other persons borne on the

books or for the time being on board the same, as the officer commanding one of His Majesty's

ships has for the being in respect of the officers and crew thereof or other persons on board the

same:

 

(6.) The Naval Commander-in-Chief and senior Naval Officer in His Majesty's Service shall have

the same powers over the officers and crew as if they have for the time being over the officers

and crew of any of His Majesty's ships.

 

It is further agreed by the said Robert Fleming Herschel provisions and clothing,* and allowances in connection therewith, will be issued according to the Regulations for H.M. Naval Service, and that in the event of death or injury caused by acts of the enemy pensions or gratuities in accordance with the Regulations printed on the last page hereof.

In witness whereof the same parties have subscribed their names on the other side hereof on the day specified against their respective signatures.
